Terms of Service
Last updated 28 September 2026
Incentive Radar is a sole proprietorship operated by Ima Kennerly in the United States.
The short version. Incentive Radar is a data subscription. It collects what US state governments publish about their film and television production incentives, puts it in one consistent structure, links every figure to the document it came from, and sends you a digest. Incentive Radar is not a law firm, an accounting firm, or a tax advisor, and nothing it publishes is advice. Verify anything you rely on against the linked source document.
1. Who operates Incentive Radar
Incentive Radar is operated by Ima Kennerly as a sole proprietorship in the United States. Contact: [email protected]. In these terms, “Incentive Radar” means the business and its operator; “you” means the person or organization holding the subscription.
2. What the service is
A subscription gives you access to some combination of the recurring digest, the structured dataset, and data exports, depending on your tier. What each tier includes is described at the point of purchase. Incentive Radar may add to a tier; if something material is removed from a tier you are already paying for, you will be told before your next renewal and you may cancel under section 6.
3. What the service is not
- Not advice. Nothing here is legal, tax, accounting, financial, or investment advice, and reading it creates no professional relationship.
- Not a filing service. Incentive Radar does not prepare, submit, or review incentive applications, and has no relationship with any film office or state agency.
- Not an official source. Incentive Radar is a secondary source. The state’s own document is the authority; the dataset is a structured copy of it with a link back.
- Not news. Incentive Radar does not claim to report allocations first. Trade publications often cover large-state announcements the same day. The work is structure, comparison, and the record over time.
4. Accuracy, and the limits of it
Every record in the dataset carries a link that resolves to the public document it was taken from. A field the source does not state is left blank rather than guessed at. Anything derived rather than read — an estimate, a rollup — is labelled as an estimate.
Even so, states publish irregularly, revise figures, and change their page layouts without notice, and mistakes happen. The data is provided “as is,” without warranty of accuracy, completeness, or fitness for a particular purpose. If you find an error, report it and it will be corrected in public: see Corrections.
5. Your account and acceptable use
- One subscription is for one person or one organization, as sold. Do not share individual login credentials outside the account.
- You may use the data internally, quote from it, and cite it, including in client work and published writing, with attribution to Incentive Radar.
- You may not republish or resell the dataset in bulk, or build a competing subscription product out of it, without a written agreement. Licensing is available on request.
- Do not scrape, hammer, or attempt to circumvent access controls. If you want programmatic access, ask; a keyed feed is on the roadmap.
6. Billing, renewal, and cancellation
Payments are processed by Stripe; Incentive Radar never sees or stores your card number. Prices are shown before purchase and include the billing period. Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time from your account; cancellation stops the next charge and your access continues to the end of the period you have already paid for. Refunds are covered by the refund policy.
If a price changes, existing subscribers are told at least 30 days before it applies to their renewal. A Founding Member rate, where offered, is honoured for as long as the subscription stays active and uncancelled.
7. Suspension and termination
Incentive Radar may suspend or end an account for non-payment, for a breach of section 5, or where required by law. If Incentive Radar ends your account for any other reason, the unused part of the period you have paid for is refunded.
8. Intellectual property
The underlying facts come from public government records and are not Incentive Radar’s to own. The structure, schema, normalization, written analysis, charts, and site belong to Incentive Radar. Your data is yours.
9. Liability
To the extent the law allows, Incentive Radar’s total liability to you for any claim arising out of the service is limited to the amount you paid Incentive Radar in the twelve months before the claim, and Incentive Radar is not liable for indirect, incidental, or consequential loss — including lost profits or a decision made in reliance on a figure. Nothing here limits liability that cannot lawfully be limited. Some jurisdictions do not allow these limits, in which case they apply to you only as far as they lawfully can.
10. Changes to these terms
These terms may be updated. The date at the top always reflects the current version. If a change materially reduces your rights, subscribers will be told by email before it takes effect.
11. Governing law and disputes
These terms are governed by the law of the State of New York, United States, without regard to its conflict-of-laws rules. Before filing anything, email [email protected]. Nearly everything at this size is solved in one message.
